Terms of Use
These terms govern access to and use of MaghrebCars as a car rental matchmaking platform for Morocco. They do not create a vehicle rental agreement between the user and MaghrebCars.

1. Role of MaghrebCars
MaghrebCars is an electronic interface operated by Amine Bendarkaoui, a German sole proprietorship providing IT consulting, software development and software-related services, to connect customers with car rental providers in Morocco.
MaghrebCars is not a traditional car rental company, does not own the listed vehicles and does not act as rental provider, sub-lessor, insurer, custodian of vehicles or legal agent of providers unless expressly agreed in writing.
2. Rental agreement
The platform allows users to search offers, send booking requests and exchange the information needed to prepare a rental.
The rental agreement, vehicle handover, local documents, guarantees, insurance, deposit, on-site payment and operational obligations remain agreed and performed directly between the customer and the relevant provider in Morocco.
3. Payment
MaghrebCars does not currently process online rental payments and is not a payment service provider.
Payment is made according to the offer information and the arrangements agreed with the provider, typically at handover or directly to the provider. MaghrebCars does not provide escrow, payment custody or online payment processing for rentals.
4. Provider obligations
Each provider is responsible for the accuracy of its information, prices, availability, vehicle condition, insurance, compliance and proper performance of the rental.
Providers must in particular:
- provide accurate business and verification information, including ICE, RC city, RC number and the Modele 7 register document when requested for verification;
- not upload CIN, passport, identity card or other personal identity documents;
- not enter card, bank account, IBAN, RIB, CVV, password or secret code data in free-text fields;
- keep public or operational contact details accurate, including phone or WhatsApp when the provider chooses to provide them.
5. Customer obligations
Customers must provide accurate information, use the platform in good faith, comply with applicable Moroccan rules and check the rental conditions before taking possession of the vehicle.
Customers must not enter payment data, card data, bank account data, passwords, secret codes or identity document data in comments, messages or reviews.
6. Contact and booking data
Booking data is shared only to the extent necessary to process the request and perform the rental.
When a customer submits a booking request, direct contact details such as email and phone are shared only with the relevant provider so that the provider can review the request, verify the conditions and arrange the rental. They are never displayed publicly.
A provider's phone or WhatsApp may be shown publicly or operationally when the provider provides those details as a contact method.
7. Reviews
Reviews follow a double-blind logic: reviews remain hidden until both sides submit their review or until the review period expires.
Only published customer-to-provider reviews may appear publicly. Provider-to-customer reviews are not displayed on public pages.
Reviews must not include sensitive data, payment data, secrets, identity documents or unnecessary contact details.
8. Cancellation and trust system
MaghrebCars uses a trust and penalty system to limit late cancellations, no-shows and abusive cancellations, without changing the fact that MaghrebCars is not a party to the rental agreement.
A cancellation more than 48 hours before the scheduled pickup is free. A late cancellation or no-show may create a warning, restriction or suspension of the right to book. Provider cancellations may reduce their visibility on the platform.
9. Liability
To the extent permitted by applicable law, MaghrebCars is not liable for damage, delays, cancellations, refusal to hand over a vehicle, mechanical defects, fines, deposit disputes, payment disputes or contractual breaches connected with the rental.
Any claim relating to the vehicle, its handover, condition, use, return, on-site payment or insurance must be handled directly with the relevant provider, without prejudice to mandatory legal rights.
10. Suspension and security
MaghrebCars may suspend, limit or remove an account, offer, booking request or access in case of fraud, abuse, legal risk, security issue, violation of these terms or request from a competent authority.
The platform is provided with a reasonable level of availability. MaghrebCars does not guarantee permanent absence of interruption, error or technical incompatibility.
11. Applicable law and update
MaghrebCars is operated by a sole proprietorship established in Germany, while rentals prepared through the platform are performed in Morocco. The applicable rules may depend on the specific situation, place of performance and status of the parties.
